The suit filed against Archive.org is horrible. They're archiving human knowledge and giving it away for free. Some rat-bastard company is trying to exploit the undefined nature of internet law so that they can protect their profits. We saw a similar thing happen with the Aussies, and with the recent MGM v. Grokster Supreme Court decision.
The issue was with compliance with robots.txt. The plaintiff is arguing that Archive.org failed to "comply" with the file. Really, robots.txt is a totally voluntary protocol for web spiders to observe at their discretion. Trying to explain that to a judge who has never used a computer is going to be quite difficult. This raises huge issues about caching, liability, and "ownership" of information.

I think the idea is cool. But when you update a site it is not nesecarily for new info. In my case I have been cease and desisted on numerous occasions for using images without permission, on my spoof site. Also I made a monatge image that contained images from a movie that I did not have permission to use. Needless to say I comply with the requests when I get them, yet lo and behold, the images and old sites are still there!! My concern is that I will still be held liable for those images, and considered deliquent in the original requests. My first thought is no, because I am not hosting the site, nor do I own it, or have any say in what is there. I think legally I would be OKAY, but like Jon said, how do you explain that to a judge who has never used a computer??

cgg -- study up on DMCA cases. Under American copyright law, you have a right to use images for "criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research". Criticism includes parody. Lots of people are now using cease and desist letters to control information on the web, because people don't fully understand the law.
Archive.org has the same rights that a library has, and they're explicitly defined. This is another example of a crazy lawsuit designed to control the flow of information.

I realize that but fighting costs money. I wait for the legal letters, then I stop. Trust me, I cant afford to fight the 700 club or Jimmy Swaggart. I have never been "scared" or felt threatened by Cease and desists, thats just when I "stop". My site is partially owned by my brother and I dont want to make him liable too. Again I will talk to my lawyer about the images still existing in an archive.

Submit your C&D letters to http://www.chillingeffects.org . There are also places where you can get free legal help when companies try to bully you.

Yea that is a messed up situation they are in....I mean webpages DO put COOKIES on your harddrive...Libraries DO store Old info, this is a FREE service. Its not like they are making money off others works or even claiming it as theirs. I bet that place has saved a few people thats lost all their data including backups...But like you said its gonna be hard trying to convince a judge whats goin on.
"Lets sweep the dirt under the rug and sue whoever lifts the rug" seems like their kind of thinking.(the suer/plantiff) Only thing i thought would be semi illegal...they have old movies and shows....(6 episodes of 3 stooges, warbabies, killer dill, night of the living dead original)...theres some 1940-160 commercials with chevrolet and dodge, etc commercials (pretty good stuff) I liked the chinese jello baby ad, hillarious...im strayin off subject... I think its great they are archiving this stuff....I mean what if our kids are net junkies too, if that site is still around we could be like yea this is what the net was like when i was your age, check out all the porn we had nah, but ya know what I mean.
