Ford 9" ring gear Questions

Hi Guys, I need some help deciding what to do about this--- I was sold a "GOOD USED" Ford 9" Posi 3d member by a local Mustang shop in Blue Ash Ohio. He said it was good to bolt in; but failed to put in a new crush sleeve when changing the yoke so the preload was way off on the pinion bearings, and the seal looked like it came off a 50 year old dozer. When I got it cleaned up I found it has a defeat in the ring gear. I tried to ask for my money back and he refused. :mad:

SO what do you guys think, I have attached a picture. The ring defect is on the 'coast' side of the gear but I am afraid it will make noise or worse be a notch for a crack to begin. I even replaced the crush sleeve and seal and he refused to own up to his deceit.

I see the small chip, which is not a problem, but what is the rest of the line that goes through that tooth? Is there metal missing there or is it just a mark on the tooth?

Odd looking mark and chip... did someone fill in a deeper chip with JB Weld or something similar i wonder?

Thanks for the fast reply. My hot rod is sitting on stands awaiting the resolution of this. The longer gash is into the gear mating surface, but is not very deep. It certainly is into the metal, no JB; I am familiar with that stuff;). It looks like someone dropped the gear on something hard then took a grinder to it to smooth off a burr (the chip at the edge) and missed and hit the gear face. I took a better picture.
I just don't want to go through all the hassle of putting it in if its' going to give me fits down the road.

I don't think I'd be too worried about that. I'd be more worried about the stock Traction Lock busting and wiping out everything.

What he said,as long as nothing sticks out,like a burr,an indentation like that should not make noise or give you a problem....all by the way,NO TRANS BRAKE!
