I work at a body-shop in town and was wondering if the labor laws say that im intitled to 2 15 minute breaks. One 2 hours after I started work and 1 2 hours after lunch. I cant find anything on it but im going to keep lookin.

Probably depends on how long you want to keep your job. Are you in a union?....likely not. Up here in Canada, if unionized, it is spelled out in the collective agreement. That kind of tells me that it is a negotiated thing.

Most employers give a morning and afternoon break, don't know if it is mandatory.

Hard to believe, but most states labor laws do not require ANY break during the workshift. I checked this several years ago. There are many states that have maximum number of hours for minors but nothing for adults.

Where there are labor unions there usually have been aggreements concerning breaks.

Just like he said...

Unless you have a Union job there arn't Union negotiated paid or unpaid breaks!! Some shops around here don't even allow smoke breaks all day but do allow minimal piss breaks a day!! I suggest looking at a different shop to work at. Some bosses actually treat their workers like human beings instead of animals/ or slaves!!

Are you paid on a commission base or a hourly/salary base? Most body shops around me (Michigan) are commission shops and you only get paid for what work is done. So as long as the jobs are done when need be, you can take a break when you want.

In the second FAQ box..
QUOTE" Nevada law requires that an employee who works an 8 hours shift MUST have a half hour unpaid meal break, plus a ten minute paid 10 minute break for every four hours of work."

poncho62,
I do know in Ontario, union or not you are entitled to 1/2 break after 5hrs of work. Your boss can not refuse to give you at least that, of course unpaid.

It's been many years since I worked anyplace that had scheduled breaks, other than classes that I attended. Those places were "manufacturing plant" types of places. All of the shops that I have worked in, you could take breaks basically when ever you wanted, as long as you got the work done, and didn't take advantage of the system. Then again, most places that I worked at, we were on commission.

If you are on salary or hourly, that should have been discussed before taking the job.
