They did that, over and over. There were at least 700 scalding incidents. When it came down to the 79 year old lady in the lawsuit, who got 3rd degree burns. Suddenly, McDirty decided they didn't want to pay medical bills. A jury decided otherwise, awarding $160,000 in compensatory damages (aka, her actual bills) and $2.7 million in punitive damages. A judge later reduced the punitive damages to $480,000. In other words, even on appeal, McD was found to have been so callous and disregardful of danger to customers that nearly half a million was levied against them to teach them a lesson.
It was a convincing enough defeat that McD settled for an undisclosed amount. That means they knew that they couldn't fight the facts further in a court, even with all the spin they had put out and with nearly every prospective juror thinking before hearing the facts that it was a frivolous, silly lawsuit. They knew that putting the facts before future courts would not reduce the punishment.
See Liebeck v. McDonalds.

RIght to Lifer
Im an ardent Right to Lifer, but I dont think that a fetus inside the womb qualifies as two passengers in a vehicle. Since in most states it mandates a person setting in each seat of the vehicle.
Having been a police officer for 5 yrs. and doing 19 yrs, with the Dept of Corrections, I too have seen some loonie juries. It seems that a lot of these lawyers are very adept at getting people from the shallow end of the gene pool to sit on those juries.

[QUOTE=Max Keith]Im not sure this arguement falls in the right to life catagory, as far as fetus's go, but I see it as just another whacked out way of tieing up the courts.
Agreed but, I'm sure her attorney will try and play some sort of Right-to-Life card to try and influence a befuddled, hand picked jury to feel sorry for her fetus, ultimately giving it equal rights as a passenger in the car. With all the whacked out controversy for and against Right-To-Life I've ben hearing lately, I'm not so sure this idiotic scam won't work.
I just did Jury duty around six months ago. I don't think these clowns would want me in the box, listening to all that far-flung poppycock.

Her law suit makes about as much sense as the gal that sued McD because of her spilling her hot coffee on herself, while driving in traffic.
Wonder why that judge didnt have her charged with failure to operate or careless driving? Hmmmmm
NM, the obsurdity of it all is too much for me to even want to digest.

|38 special||I say fine the fetus. He/she was driving while asleep causing undue stress to other drivers on the highway. This is one for the judge to act like a judge and throw out of court. Plus fine any lawyer willing/or disbarr (like someone said) willing to take the case. You guys might be right she should be paying double for everything, if she wins this one. Whats fair is fair.|

[QUOTE=WildBill]Okay. Let's follow this to it's logical end. She needs two seats at the movies, pays double at a salad bar, and buys two tickets for a bus or airplane flight.
Bill - that's about as logical as it gets, you must be Vulcan! I hereby deputize you as County Prosecutor.

Okay. Let's follow this to it's logical end. She needs two seats at the movies, pays double at a salad bar, and buys two tickets for a bus or airplane flight.
They ought to accept her dumb-*** argument and then fine her for not having her passanger in its seat belt.
I am four-square against government intervention in just about everything but people like her make me think that we need breeding licenses.

I'm afraid that the dingbat in question is a resident of Atlanta. One more reason for me to avoid the place like the plague.
