TH350 shifting problem

ok i bought a brand new TCI TH350 from summitracing, its behind a 355cid, for some reason it is very picky on when it will shift into 3rd. it stays in 2nd under light load and full throttle. I've tried adjusting the modulator numerous times and it doesnt seem to help, also it has a clunk in the transmission when i come to a complete stop?

Does the tranny come with a shift kit? I think I would call the manufacturer and see if this is normal. Any other thoughts out there? Sane thoughts, that is....
